1. Acceptance of Terms

By accessing and using Breeze / trybreeze.app ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Breeze is a self-serve AI product photography platform. Users can upload product images and generate digital outputs such as professional studio shots or lifestyle content using artificial intelligence.

All outputs are delivered electronically as digital files. No physical goods or services are provided.

3. AI-Generated Content Disclaimer

IMPORTANT: The images generated by our Service are created using artificial intelligence technology. These are complex computational processes that involve numerous variables and algorithms. We do not guarantee, warrant, or represent that:

• The generated images will be exact representations of how items will appear in reality
• The AI-generated results will meet your expectations or specific requirements
• The colors, textures, fit, or appearance in generated images will match actual products perfectly
• The technology will produce error-free or perfect results in all circumstances

AI image generation is an evolving technology with inherent limitations. Results may vary based on input quality, lighting conditions, image resolution, and other factors beyond our control. You acknowledge and agree that you use the Service and rely on AI-generated content at your own risk.

4. Payment Terms

4.1 Payment Processor – Lemon Squeezy

Payments for Breeze credit packs and subscription plans are processed by Lemon Squeezy, our Merchant of Record. Lemon Squeezy handles:

• Payment processing
• Subscription billing
• Invoicing and receipts
• Tax collection and remittance
• Refunds according to their Terms

We do not store or process your full payment information. All billing-related inquiries, including disputes, payment method issues, and VAT/GST questions, are handled directly by Lemon Squeezy as the Merchant of Record.

4.2 Refund Policy

Due to the digital nature of our products, all sales are final. Refunds may be granted at our discretion in exceptional cases such as accidental duplicate purchases or technical issues preventing service usage.

5. Pricing Plans

Breeze offers subscription plans to suit different needs. All prices are in USD and subject to change.

One-Time Credit Packs

For users who prefer not to commit to a subscription, we offer one-time credit packs.

Credit Usage

• Standard Image: 1 Credit
• Premium/High-Res Image: 5 Credits

6. User Accounts & Security

To use certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

7. User Content & Intellectual Property

7.1 User Uploads

You retain ownership of the photos and content you upload to the Service. You grant us a license to process these images solely to provide the Service.

7.2 AI-Generated Outputs

Breeze grants you full rights to AI-generated outputs created from your uploaded images. You are responsible for ensuring your uploads do not infringe third-party rights.

8. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To transmit any advertising or promotional material without our prior written consent.
• To impersonate the company, an employee, another user, or any other person.
• To upload malicious code, viruses, or any other harmful computer code.
• In any way that infringes upon the rights of others, or is illegal, threatening, fraudulent, or harmful.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BREEZE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Breeze and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Breeze operates, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.
